Adoption

It is of the utmost importance to have the assistance of a qualified attorney when you are going through adoption proceedings. This will help to ensure the integrity of your adoption agreement and the smooth transfer of parental rights. The adoption process is a two-step procedure. First the parent-child relationship between the child and his or her birth parents must be terminated either by court order or by the death of the parent(s) before an adoption may be granted. The termination of parental rights may be accomplished by either a voluntary relinquishment by a birth parent or an involuntary action taken against the birth parent. Grounds for involuntary termination of parental rights include failure to provide child support, abuse or neglect of the child, abandonment of the child, or incarceration of the parent. It must be proven that the termination of the parent-child relationship is in the child's best interest. 

Second, once the parent-child relationship has been terminated, then the adoption process can begin. Part of the adoption process includes a social study of the perspective adoptive parents. The child must reside in the home of the adoptive parents for a minimum of six months before the adoption can be finalized in court.
